1. Check Expiring LCAs First
Start with your most time-sensitive cases, especially for employees whose H-1B or E-3 ststauses are expiring soon. A delayed renewal could disrupt work authorization, so prioritize filings that were on hold during the system outage.
2. Double-Check Every Detail
Before submitting, review your LCA carefully. Ensure the worksite address matches the actual work location (including remote or hybrid setups), and confirm that wage levels reflect current DOL data. Even small discrepancies can cause headaches later.
3. Keep Public Access Files Updated
Within one business day of filing, employers are required to make supporting documentation, such as wage data, signed forms, and posting notices, publicly accessible. Keeping this file organized protects you if the DOL audits your case later.
4. Expect Some Delays
Although the FLAG system is back, processing queues may take time to normalize. Track your case status regularly, and plan ahead for roles where work authorization timelines are tight.
